Anyone who has ever attended a baseball game, be it the Jacksonville Suns or a major league event, has heard the PA announcer warn them that they are agreeing to bear some risks, like those associated with baseballs and broken bats flying about.
One litigant found a loophole of sorts. He sued the Kansas City Royals after being hit by a hot dog the team’s mascot had fired into the stands. And wouldn’t you know, but the Court of Appeals gave him his day in court. After all, hot dog projectiles are not a risk inherent to the game of baseball.
